DMCA Policy - Flixfox

Flixfox is committed to compliance with India’s Copyright Act, 1957, the Information Technology Act, 2000, and the Digital Millennium Copyright Act (DMCA). We take the prevention of unauthorized exhibition, reproduction, or distribution of copyrighted content very seriously. To ensure we can continue to serve our Indian users in a lawful manner, we have recently updated the DMCA procedure for copyright holders and introduced new changes, which have also been communicated to all users.

1. Submitting a Copyright Infringement Takedown Notice

If you are a copyright owner or an authorized agent, and believe that any content stored on Flixfox infringes your copyrighted work, you may submit a written takedown notice to our registered DMCA Copyright Agent. Your notice must include the following information:

An identification of the copyrighted work claimed to have been infringed (or a representative list of such works, if a single notification covers multiple copyrighted materials on Flixfox);

Identification of the allegedly infringing material, along with information reasonably sufficient to permit us to locate the material on Flixfox;

Your full contact information (physical address, telephone number, and email address);

A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law;

A statement made under penalty of perjury that all details in your takedown notice are accurate, and that you are either the copyright owner or authorized to act on behalf of the copyright owner;

Your physical or electronic signature.

2. Takedown Request Processing

Please send legitimate DMCA takedown requests to our copyright compliance team in India. We will take the following actions upon receipt of a valid request:

Acknowledge receipt of a fully compliant complaint within 48 business hours;

Remove or disable access to the infringing material within 72 hours of receiving the valid notice, in accordance with India’s IT Rules, 2021;

Notify the user who uploaded the content of the takedown and provide them with an opportunity to file a counter-notice if they believe the removal was a mistake.

3. Rejection of Invalid Requests & Repeat Infringer Policy

Flixfox reserves the right to reject takedown requests that are made in bad faith, incomplete, or inaccurate.

Furthermore, users who repeatedly post infringing material may have their accounts terminated without prior notice.

Note: This policy applies exclusively to allegations of copyright infringement (and not to complaints filed under other provisions of Indian law). All emails related to this matter should be sent directly to our grievance officer in India in accordance with our Terms of Service.

4. Policy Updates

This DMCA Policy will be periodically revised to reflect changes in our platform’s operations and legislative developments. For material updates, Flixfox users in India will be notified via in-app pop-ups.
